1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website at businessmodernizer.com (the "Site") and any related services provided by Volkinator Enterprises, Inc., doing business as Franchise Modernizer ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Services

Franchise Modernizer provides fractional Chief AI Officer services, AI implementation consulting, automation engineering, and workforce training for franchise organizations. The specific scope, deliverables, and fees for any engagement will be defined in a separate service agreement or statement of work between you and Franchise Modernizer.

The Site provides general information about our services and includes tools such as the AI Readiness Scorecard, contact forms, and strategy session booking forms. Use of these tools does not create a client relationship or constitute professional advice.

3. User Accounts

Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or unauthorized activity.

4. Payment Terms

If you purchase services through the Site, you agree to pay all applicable fees as described at the time of purchase. Payment is due upon receipt unless otherwise specified in a separate service agreement. All fees are non-refundable unless expressly stated otherwise.

We reserve the right to modify pricing at any time. Price changes will not affect services already purchased under an existing agreement.

All content on the Site, including text, graphics, logos, images, videos, software, and design elements, is the property of Volkinator Enterprises, Inc. or its licensors and is protected by U.S. and international intellectual property laws.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific business results from using our services or tools, including the AI Readiness Scorecard.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOLKINATOR ENTERPRISES, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
